Helfie apps may not be used to make decisions in situations that are considered life-threatening.
Terms of Use
Access to and use of the website located at www.helfie.ai, including any sub-domains, as may be added to or varied by us from time to time (Website) and the products and services available through the Website (Services) is subject to the following terms and conditions (Terms of Use). By using or accessing the Website you agree to be bound by these Terms of Use.
In these Terms of Use, a reference to we, us and our means Helfie Management Pty Ltd. A reference to you or your in these Terms is a reference to any person, accessing, reviewing or using the Website.
Except to the extent that these Terms of Use apply or as required by law, your use of the Website and receipt of any information from it does not create any legal relationship between you and us.
1. Amendments to Terms of Use
We reserve the right to amend these Terms of Use from time to time. Amendments will be effective immediately once they appear on the Website. Your continued use of the Website will represent an agreement by you to be bound by the Terms of Use as amended.
2. Website
Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Website.

The Website may contain links to other websites (Linked Sites), which are not operated by us. We have no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. 4. Website Health Check
Health check applications might from time to time be accessible via the Website. The use of our health checks is subject to end user terms and conditions contained in the relevant application. Information or data collected in these checks is used strictly in accordance with our Privacy Policy. Depending on your device settings, the computer or mobile device being used for these checks might request permissions, for example, the use of your microphone to record audio. Read the permissions carefully before proceeding and read our Privacy Policy for more information about how your data is stored and used.

Helfie Mobile APP
These Terms and Conditions (“Terms”) govern your access to and use of the Helfie mobile application and related services (the “App”), operated by Helfie Management Pty Ltd (“Helfie,” “we,” “us,” or “our”). By downloading, installing, registering for, or using the App, you agree to be bound by these Terms. If you do not agree, do not access or use the App.
1. Eligibility and Account Registration
1.1 Eligibility. You must be at least 16 years old to use the App. If you are under 18, you may use the App only with the involvement and consent of a parent or guardian

1.2 Account. To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any unauthorised use.
2. License Grant and Restrictions
2.1 License. Helfie grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes in accordance with these Terms and any app-store license terms.
2.2 Restrictions. You may not (and may not permit others to):

reverse engineer, decompile, or disassemble the App;

modify, adapt, or create derivative works of the App;

rent, lease, lend, sell, redistribute, or sublicense the App;

remove, obscure, or alter any proprietary notices;

use the App in violation of applicable law or third-party rights.
3. User Conduct
3.1 Prohibited Conduct. You agree not to:

use the App to harass, abuse, or harm others;

upload viruses, malware, or other harmful code;

interfere with or disrupt the App’s performance;

scrape, harvest, or collect data from the App without authorisation;

impersonate any person or misrepresent your affiliation with any person or entity.
3.2 Health Advice Disclaimer. The App provides general health information and AI-driven insights. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for personalised care.
4. Intellectual Property
4.1 Ownership. The App, all content, features, and functionality (including text, graphics, logos, software, and AI models) are owned or licensed by Helfie and are protected by copyright, trademark, patent, and other intellectual property laws.
4.2 Feedback. If you submit feedback or suggestions, you assign all rights in such feedback to Helfie, and Helfie is free to use and commercialise it without restriction.
5. Third-Party Services and Links
The App may integrate with or link to third-party services (such as wearables, telehealth platforms, or analytics providers). Your use of those services is governed by the third party’s terms and privacy practices. We are not responsible for their content, policies, or practices.
6. Payments and Subscriptions
6.1 In-App Purchases. Certain features may require payment or a subscription. All purchases are processed via your device’s app store. You agree to the app store’s purchase terms and policies.
6.2 Renewals and Cancellations. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage and cancel your subscription through your app-store account settings.
6.3 Refunds. Once you add funds to your Helfie wallet, Refunds are not possible. Your Helfie wallet balance never expires.
8. Beta Features or AI Limitations
Some features of the App may be labeled as "beta," "experimental," or "AI-generated." These features are provided for evaluation purposes only and may be incomplete or contain inaccuracies.
9. Export Restrictions
You agree that you will not use or access the App in violation of any applicable export control or sanctions laws, including those administered by the Australian Government, the U.S. Department of the Treasury, or other applicable authorities.
10. Termination
7.1 By You. You may delete the App and close your account at any time via the App’s settings.
7.2 By Helfie. We may suspend or terminate your access for any violation of these Terms or any applicable law, or for any other reason, without prior notice. Upon termination, your right to use the App ceases immediately.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, HELFIE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HELFIE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR COMPLETELY SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HELFIE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HELFIE’S TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED AUD 100.
13. Indemnification
You agree to indemnify, defend, and hold harmless Helfie and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your use of the App.
14. Governing Law and Dispute Resolution
These Terms and your use of the App are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Melbourne, Victoria.
15. Changes to Terms
We may update these Terms to reflect changes in our practices or applicable law. If we make material changes, we will notify you via the App or by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
17. Waiver
No waiver of any breach of these Terms will constitute a waiver of any other or subsequent breach.
18. Entire Agreement
These Terms, together with the Privacy Policy and any app-store license terms, constitute the entire agreement between you and Helfie regarding the App and supersede all prior agreements or understandings.
